In Alberta, most malpractice and product liability actions are brought in the Court of Queen’s Bench. The exceptions include: actions for $25,000.00 or less which can be brought in the Civil Division of the Provincial Court; and actions against practitioners employed by the Federal Government which can be brought in the Federal Court.

The steps in an action brought in the Court of Queen’s Bench of Alberta include:

  • pleadings
  • notices to admit
  • affidavits of records
  • examinations for discovery
  • applications
  • service of the statements of experts
  • pre-trial conferences
  • trials
  • appeals
