Historical Sexual Abuse

Many survivors of sexual abuse carry the impact of their experiences for decades. For some, it takes years to recognize the abuse for what it was or to feel safe enough to come forward. At Weir Bowen LLP, we understand the courage it takes to speak up about historical sexual abuse, and we’re here to help you navigate the legal path forward with care and compassion.

What Is Historical Sexual Abuse?

Historical sexual abuse refers to abuse that occurred in the past, often during childhood or adolescence, but is being reported or pursued legally years (or even decades) later. Survivors may have been harmed by:

  • Family members or caregivers
  • Teachers, coaches, or mentors
  • Religious leaders or institutional staff
  • Individuals in foster care or group home settings

In many cases, survivors delayed disclosure due to fear, trauma, shame, or a lack of support. The legal system now recognizes that these delays are common and justified.

Can I Still Make a Claim?

Yes. In Alberta, there are no longer limitation periods for most civil claims involving sexual abuse. This means that even if the abuse happened many years ago, you may still be eligible to pursue legal action.

Survivors can seek compensation for:

  • Emotional and psychological harm
  • Loss of quality of life
  • Therapy and recovery costs
  • Income loss (past or future)
  • Loss of ability to form interdependent relationship
  • Other damages, depending on the case

We will work with you to understand your story and determine the best legal route based on the facts and your goals.

INDIGENOUS LAND ACKNOWLEDGEMENT

The lands on which Edmonton sits and the North Saskatchewan River that runs through it have been the sites of natural abundance, ceremony and culture, travel and rest, relationship building, making, and trading for Indigenous peoples since time immemorial. Edmonton is located within Treaty 6 Territory and within the Metis homelands and Metis Nation of Alberta Region 4. We acknowledge this land as the traditional territories of many First Nations such as the Nehiyaw (Cree), Denesuline (Dene), Nakota Sioux (Stoney), Anishinaabe (Saulteaux) and Niitsitapi (Blackfoot).

Weir Bowen acknowledges the many First Nations, Métis and Inuit who have lived in and cared for these lands for generations. We are grateful for the traditional Knowledge Keepers and Elders who are still with us today and those who have gone before us. We make this acknowledgement as an act of reconciliation and gratitude to those whose territory we reside on or are visiting.
